More than just a cruise

 The following terms and conditions govern the rental of recreational craft with crew by the company YACHT RENTING SERVICES to the CLIENT who makes use of the services and products offered through the website yachtrs.com.

TOTAL OR PARTIAL TERMINATION OF THE RENTAL CONTRACT BY THE CLIENT

If the CLIENT renounces the rental, cancellation fees will be due to YACHT RENTING SERVICES under the following conditions:

If the cancellation occurs:

• more than 6 months before the beginning of the rental period, YACHT RENTING SERVICES will only charge the booking fees.
• less than 6 months before the beginning of the rental, YACHT RENTING SERVICES will retain the deposits.

In any case, if YACHT RENTING SERVICES manages to rent the reserved yacht afterwards, it will refund the totality of the paid deposits decreased by the booking fees.

At the time of departure, if the rented yacht is not able to sail, either because it lacks an essential safety element, or because it does not comply with the regulations and if YACHT RENTING SERVICES is unable to offer a yacht with similar characteristics, the CLIENT may terminate the rental and obtain the return of the sums paid to the exclusion of any other compensation. The CLIENT may not refuse the rental of a replacement yacht of similar characteristics and whose cost does not exceed 10% of the value of the initial rental.

TOTAL OR PARTIAL TERMINATION BY YACHT RENTING SERVICES

In the event that, as a result of damage occurring during the previous rental or of an impediment beyond its control, YACHT RENTING SERVICES cannot give the CLIENT the use of the rented yacht on the agreed date, it will be obliged either to provide the CLIENT with a yacht of similar characteristics whose cost shall not exceed 10% of the value of the agreed initial, or to return the deposits paid, to the exclusion of any other compensation.

In the event of a special weather report, the cruise shall be cancelled and the deposit refunded by YACHT RENTING SERVICES.

PAYMENT TERMS

In the event of a booking made between 1 to 12 months before departure, the CLIENT must remit a deposit of 30% at the booking time, a second deposit of 30% one month before departure and the balance must be paid on the day of departure.

In the event of a booking made less than one month before departure, the CLIENT must remit a deposit of 60% at the booking time and the balance must be paid on the day of departure.

In the event of non-compliance by the CLIENT with the above-mentioned payment deadlines, 

YACHT RENTING SERVICES will retain the sums paid as compensation.

The prices are communicated in the booking estimate and are expressed in MAD T.T.C. unless otherwise indicated. The prices are inclusive of consumable materials (fuel, kitchen fuel, batteries, possible tolls, and, in general, all consumable materials necessary for the good functioning and maintenance of the yacht during the rental period).

LIABILITY – SECURITY – INSURANCE

The CLIENT agrees and acknowledges that he is responsible for the proper condition and use of the yacht, and agrees to cover the cost of any damage to the yacht, its accessories or finishes resulting from negligence, misuse or misconduct of any passenger during the cruise.

At the time of the reservation, the CUSTOMER presents to YACHT RENTING SERVICES a certificate of good standing and a letter of comfort of his bank of place confirming the subscription of a guarantee up to 500.000 MAD or equivalent in foreign currency, if necessary.

In the case of damage, YACHT RENTING SERVICES will send an e-mail to the CLIENT with the proven proof of damage within 48 working hours after the completion of the cruise.

The repairs of the damage caused will be invoiced in full to the CLIENT of the cruise.

Furthermore, YACHT RENTING SERVICES declines all responsibility for damages and losses of any kind concerning personal effects, objects or materials taken on board by the passengers.

YACHT RENTING SERVICES declares that it has taken out an all-risk insurance policy, allowing it to carry out its activity.

FORCE MAJEURE

YACHT RENTING SERVICES shall not be liable for any loss, damage or delay or failure in the performance of the rental resulting from any force majeure event, including (but not limited to) war, threat of war, riot, civil or labour unrest, terrorist attack and its consequences, natural or nuclear disaster, fire, a natural disaster, technical transport problems that neither we nor our suppliers could foresee, closed or congested ports, cyclones or other adverse weather conditions, floods, epidemics, health hazards, pandemics and any other cause beyond the control of YACHT RENTING SERVICES which makes it impossible to continue operations.

CONDUCT OF THE SERVICE

Passengers undertake to present themselves for boarding at the latest 1 hour before departure.

In the event of CLIENT delay, the cruise will be reduced by the same amount of time as the delay, without any compensation being paid to the CLIENT.

Any violation of the following points, without this list being exhaustive, constitutes grounds for cancellation of the cruise without the right to any type of refund:

• The use of drugs or narcotics is strictly prohibited.
• The abuse or inappropriate use of alcohol is strictly prohibited.
• Children under 8 years of age are not allowed to be alone anywhere on the yacht.
• It is strictly prohibited to throw food or any object into the sea.
• It is strictly prohibited to stand anywhere other than on the floor of the yacht.
• It is strictly prohibited to jump into the water without prior permission from the crew.
• It is strictly prohibited to separate from the group during snorkelling activities without prior permission.
• Swimming is strictly prohibited if the person has consumed alcohol without moderation.
• Swimming under the yacht is strictly prohibited.
• Touching any of the yacht's navigation equipment or controls is strictly prohibited.

CLAIMS

Claims must be made in writing at the time of hire or at the time of handover using the contact form available on yachtrs.com or by email to contact@yachtrs.com.

MEDIATION/ COMPETENT COURT

In case of dispute and before going to court, the CLIENT must have recourse to the mediation of a person chosen by mutual agreement with YACHT RENTING SERVICES, in order to reach an amicable solution.

In case of failure of amicable solution, within one month, any dispute will be submitted to the competence of the Moroccan courts.
